General Terms & Conditions of Sale

Conditions of online purchase and sale

The terms and conditions ("Terms and Conditions") are governed by the use and purchase of products through the online store Museu Nacional Ferroviário ("MNF Online Store"), which belongs to the National Railway Museum Foundation, legal person 510081266, with the registered name at Rua Eng.º Ferreira de Mesquita, 1-A, 2330-152 Entroncamento, with the e-mail address servicoaocliente@fmnf.pt and telephone contact +351 249130382.

Please read the Terms and Conditions carefully before finalizing your purchase.

When using the Online Store, making an order or purchasing products through it, you will be considered a customer ("Customer"), assuming that you have read the Terms and Conditions and are accepting and binding to them. Therefore, if you do not agree to the Terms and Conditions, you should not use the Online Store.

Ordering process

1.To place an order, you must select the products you want to purchase and add them to the shopping cart by selecting the color (if applicable) and quantity, then click "Buy".

2. Once you have selected the products you want to purchase, you should access "my cart", where you can view all selected products, their quantities and the associated cost.

3.For the purpose of confirming your order, you must complete the form provided ("Delivery Data"), in which you must provide the following details: name, email address, full address and telephone contact. This data is indispensable for the fulfillment of your order. Your inaccuracy or omission is the sole responsibility of the Customer.

4. For billing purposes you must indicate the NIF. As for the other data (Customer's name or name, address) you may use the data used in the delivery form or provide other data.

5. Upon completion of the previous steps, and the selection of the payment method, the Customer must confirm the data contained in the order summary, including the products to be purchased, the Customer and billing data, the delivery data and the total value of the order.

6. You must select whether you want delivery to the address or store of the National Railway Museum.

7. You must select one of the available means of payment: bank transfer or Paypal.

8. You will receive confirmation of your order in the provided email. This confirmation indicates the order summary and the order number. If you have any questions regarding your order, please contact us through servicoaocliente@fmnf.pt. servicoaocliente@fmnf.pt.

9.As soon as the National Railway Museum confirms the payment and accepts your order, it will be dispatched, being notified through the email contact received at the time of the order confirmation. This will formalize the contract between the National Railway Museum Foundation and the Client. Delivery times are stipulated in the "Delivery" section.

10. Your order invoice will be sent by email after your purchase.



 

Payment methods

To precede the payment of your order you can choose between bank transfer or Paypal.
If you select the bank transfer as your payment method, you must submit your payment receipt on the form or send it to servicoaocliente@fmnf.pt.
When you make a payment with Paypal, you will be directed to the Paypal page for confirmation of payment. After this process, your order is automatically confirmed.
No other payment methods will be accepted.


 

Delivery

The Customer may choose to deliver to the National Railway Museum or at the address selected for this purpose.

The costs and time associated with deliveries are:

Countries/delivery time
Mainland Portugal - 4€; delivery between 3 to 5 business days
Portugal Autonomous Regions - 7€; delivery between 4 to 15 business days
Spain - 5€; delivery between 3 to 5 business days
Spain Autonomous Regions, Europe and the rest of the World - cost of delivery calculated at check-out; delivery between 3 to 15 business days
Offer of shipping costs: for Portugal, for purchases over 50€.

If, for any reason, the National Railway Museum is unable to meet the delivery date, the Customer will be immediately informed of this fact, being given the option of continuity of the purchase of the products.


 

Taxes

The retail price to the public includes VAT at the rate in force, unless stated otherwise.
For orders within the European Union: all taxes and fees are included in the final price.
For orders outside the European Union and for non-customs territories for the purposes of the Union Customs Code: the Customer may have to bear additional costs relating to customs duties, import duties and other charges related to the order. The National Railway Museum Foundation has no control over these additional costs, and cannot predict what amount may be charged.

 

Right of Free Resolution

The Client has the right of free resolving by virtue of which may resolve the contract, without the need to indicate the reason.
In order to exercise this right, the product must be in perfect condition and all parts, labels and proof of payment must be kept.
The period for exercising this right of resolution is 14 working days from the day following the day of receipt of the product.
In order to exercise its right of resolution, you must communicate your decision to resolve the contract by an unequivocal statement, and you may do it through the e-mail servicoaocliente@fmnf.pt or by letter to the address Rua Eng. Ferreira de Mesquita, 1-A, 2330-152 Entroncamento, within the deadline for free resolution.
In the event of a resolution, you will be reimbursed for your payments by virtue of the order placed, up to 14 days from the date on which the National Railway Museum Foundation was informed of its decision to cancel the contract. Refunds are made using the same payment method that customer used in the initial transaction. In any case, it does not incur any costs as a result of such reimbursement.


 

Exchanges

Exchanges can be made up to 14 days after purchase, upon presentation of receipt of purchase and ensuring that the product is in the same conditions in which it was received.
In case the exchange is made in store, the customer can go to the store of the National Railway Museum and take with them the product for exchange. In online exchange, the customer should contact the National Railway Museum via the email servicoaocliente@fmnf.pt and wait for indications of how to proceed.
The National Railway Museum is not responsible for the products lost in the process of sending them by the Customer.
The National Railway Museum is not responsible for shipping costs in case of exchange, except in cases where the product has been delivered defective.


 

Returns

Returns may be granted within 30 days of purchase, upon presentation of the proof and ensuring that the product is in the same conditions in which it was received.
For any return, you will need to contact the National Railway Museum via email servicoaocliente@fmnf.pt and wait for directions on how to proceed.
The refund of the purchase amount will be made through the same means of payment that was used by the customer.
The National Railway Museum is not responsible for the loss of products in the process of sending the Customer.
The National Railway Museum is not responsible for the costs associated with the return, except in cases where the product has been delivered defective, so the Customer agrees to be responsible for the payment of all costs associated with the return.


The Customer does not have the right to the free resolution of the contract in relation to the following products:

(I) Products and goods made in accordance with Customer specifications or manifestly customized;
(II) After deliver, the products are inseparably mixed with other items;
(III) Sealed goods not subject to return, for reasons of health protection or hygiene when opened after delivery;
(IV) Recordings of sealed audio or video or sealed computer programs to which the Customer has removed the seal of inviolability guarantee.


 

Product, price and content information

The National Railway Museum reserves the right to modify, without notice and at any time, the information and commercial offer presented about: products, prices, promotions, commercial conditions and services.
The price of each product will be the one that is stipulated, at each time, in the Online Store, except in case of obvious error.
In case of possible inaccuracies or inaccuracies of the information made available in the Online Store about the products, the National Railway Museum undertakes to correct this information as soon as any lapses are found.
All product orders will be subject to their availability. If there is any difficulty in the supply of products or if there are items in stock, the National Railway Museum reserves the right to provide you with information about replacement products, of equal or higher quality, that the Customer may order. If you do not wish to order any of these replacement products, we will refund you the amount you have already paid.

The information or data provided by the Customer will be processed in accordance with the information on the Processing of Personal Data. By using this website you represent that all information or data you provide is true and corresponds to reality.

Force majeurer

We will not be liable for any breach or delay of any of the obligations assumed by us, the cause of which is due to events that are outside our control (Reasons for Force Major).

The concept of Force Major shall include any act, event, failure to exercise, omission or accident that is beyond our control, including or not including the following
I. General strike, or other forms of protest that significantly affect the country.
II. Public order disturbances, revolt, invasion, terrorist attack or terrorist threat, war (declared or not) or threat or preparation for war.
III. Fire, explosion, storm, floods, earthquake, landslide, epidemic or any other natural disaster.
IV. Inability to use trains, boats, aircraft, motor transport or other means of transport, public or private.
V. Inability to use public or private telecommunications systems.


 

Applicable law and forus

For any divergence or dispute arising in the contractual relations between the National Railway Museum and the Client, Portuguese law will apply.
Any question or dispute arising from the application, interpretation, integration or execution of this contract, when it cannot be resolved by agreement of the parties, shall be submitted to the Portuguese courts.
In this regard, if the transaction has been completed through our website, we inform you that – in accordance with EU Regulation No 524/2013 – you have the option to try to resolve any dispute out of court by accessing the electronic online dispute resolution platform at http://ec.europa.eu/consumers/odr/. You can consult the updated list of Alternative Dispute Resolution Entities available under Article 17 of Law No. 144/2015 of 8 September on the Consumer Portal via the www.consumidor.pt website.

 

Miscellaneous provisions

Applicable law requires that part of the information or notifications we send must be in writing. By using the Online Store, the Customer accepts that most communications are made electronically.
For contractual purposes, the Customer agrees to use this electronic means of communication and acknowledges that all contracts, notifications, information and other notifications, information and other notifications sent electronically satisfy the legal requirement that such notifications be made in writing. This condition will not affect the rights recognized by law.
These conditions constitute the overall agreement between the Client and the National Railway Museum Foundation with respect to its purpose, replacing all terms and conditions arising from the negotiations or proposals that preceded it, and no deletion, addition, or modification of any of the provisions of these Terms and Conditions shall be valid unless it is written and signed by one or more duly authorized representatives of both parties.
If any of the provisions of these Terms and Conditions is found to be void or otherwise invalid, ineffective, or unenforceable by a competent authority, such invalidity, invalidity, ineffectiveness or unenforceability shall not affect the validated provisions of the remaining provisions.
The National Railway Museum has the right to amend these Terms and Conditions of Use at any time.
